Matthew Waszak has a commercial and public law practice, within which he is widely recognised for his specialisms in all aspects of costs litigation and litigation funding, civil procedure, group litigation and professional negligence.
He is sought after as a ‘go-to’ junior, and is regularly brought into important test cases, heavyweight group litigation and commercial litigation. He is ranked by the legal directories as a leading junior – recently described as “absolutely phenomenal”, “utterly brilliant”, “a go-to person below KC level”, a “very strong advocate” and “such a pleasure to work with”.
His recent cases have included those arising from cases featured in the Lawyer’s Top 20 Cases/Appeals for the last few years. His work also has an international dimension – including cases in Northern Ireland (having been issued with a temporary Call to the Bar in Northern Ireland in 2024), those arising from proceedings in the US as well as international arbitrations, and current proceedings in the British Overseas Territory of St Helena.
He is a contributing editor to the White Book Costs and Litigation Funding Supplement where he edits the chapter on detailed assessments and payments on account.

Matt is currently described as “one of a few leading junior counsel in relation to costs work” (Legal 500). He has a very busy costs practice, typically acting for major solicitors’ firms and defendant insurers. He is regularly instructed in cases with market-wide significance and in test cases, as well as being frequently brought into major litigation, including commercial and group litigation, to advise on or argue specific costs issues. He also acts as a costs specialist in respect of costs budgeting or costs budget variations, the application of Part 36 and in applications for wasted costs orders and non-party costs orders.

Matt is a specialist in all aspects of solicitor client costs. He has substantial experience in assessments under the Solicitors Act 1974, in relation to both contentious and non-contentious costs. He is sought after for advice by solicitors (including City and Magic Circle firms), and is very experienced in the regulatory and reputational issues that surround challenges to solicitors’ costs.
His cases often involve substantial overlap with claims for unpaid fees, claims against solicitors for professional negligence and potential disciplinary proceedings. He has retained a substantial practice in acting for solicitors in, and advising them upon, CPR r 46.4(2)(a) assessments.

Matt is a specialist in all aspects of litigation funding. He regularly advises on the terms of funding structures, solicitor’s retainers (including CFAs and DBAs), litigation funding agreements and contractual dispute resolution schemes. His non-contentious work also involves advising on funding issues in the acquisition of solicitors’ practices.
He is also regularly instructed in applications for security for costs (including disclosure applications and against litigation funders) and non-party costs orders. Matt has been closely involved in advising on the consequences of the Supreme Court’s decisions in R (on the application of PACCAR Inc and others) v Competition Appeal Tribunal [2023] UKSC 28 and Oakwood Solicitors Ltd v Menzies [2024] UKSC 34.

Matt has a specialist group litigation practice and is rapidly building up a substantial reputation in this area.
He is an expert in the funding, costs mechanics and procedural management of group litigation, including the operation of Group Litigation Orders (GLOs).
He is a regarded as a ‘go-to’ junior and, as his recent cases demonstrate, is regularly brought into group litigation in respect of his areas of expertise – including in respect of the drafting of contractual dispute resolution mechanisms and settlement agreements.
His group litigation practice involves claims subject to GLOs, those not subject to GLOs (including omnibus claims) and collective opt-out proceedings in the Competition Appeal Tribunal.

Matt acts for both claimants and defendants in cases in the county courts and the High Court. His professional liability work typically arises out of claims against solicitors and barristers (as well as other legal professionals), but he also has experience of claims against construction professionals, and is familiar with the use of the industry’s standard form contracts.
He has experience in lost litigation, under settlement, Limitation Act claims, claims arising out of personal injury and clinical negligence litigation and claims arising out of costs litigation (including assessments under the Solicitors Act 1974). He acts in complex and document heavy cases, and has experience in striking out unmeritorious claims, particularly those brought by litigants in person. He maintains a substantial practice in applications for wasted costs orders against legal professionals.
Matt has a specialist practice in consumer law, and the law relating to credit hire and motor insurance. He has been regularly instructed in such cases for the last decade, and is steeped in the dynamics and trends which underpin the motor insurance industry and the litigation arising from it.
He provides strategic advice to claims management and credit hire companies. He regularly advises on points of civil procedure (e.g. QOCS, fundamental dishonesty) and motor insurance.
He has extensive trial experience and is often instructed to argue points in Court. He recently acted for Spectra Drive Ltd (led by Benjamin Williams KC) before the Court of Appeal in Tescher v Direct Accident Management Ltd; AXA v Spectra Drive Ltd [2025] EWCA Civ 733, concerning non-party costs orders against credit hire companies; and is currently instructed in the extant appeal for permission to appeal from the Supreme Court.
Matt undertakes inquest, inquiry and wider public law work. He is experienced in lengthy, sensitive and document-heavy cases.
