Members of 4 New Square advise and act in a wide variety of disputes which involve Environmental, Social and Governance (ESG) issues, drawing on our expertise in related areas such as Banking & Financial Services, Commercial Dispute Resolution (including Group/Class Actions), Insurance and Professional Negligence as well as Public Law & Human Rights and Energy and Natural Resources.

We have experience in advising companies, individual directors, shareholders, fiduciaries and trustees (eg of charities and pensions), NGOs, Government departments and agencies and other entities in relation to issues such as:

  • Shareholder claims for breach of directors’ duties
  • Claims by investors based on allegedly misleading statements in prospectuses or similar documents
  • Claims against fiduciaries relating to the use or misuse of funds under management
  • Claims relating to environmental disasters, often pursued by way of group action
  • Claims against government entities, including by way of judicial review, relating to executive decision-making and government policy
  • Claims relating to carbon emissions and carbon trading, in a wide range of contexts
  • Governance and strategy, including the adoption and ratification of investment and risk management policies
