Artificial Intelligence (AI)

4 New Square’s barristers advise and act in disputes involving artificial intelligence, with particular expertise where AI intersects with professional liability, professional regulation and discipline, commercial disputes and the conduct of litigation.

Members have experience of cases involving suspected AI hallucinations and misuse, AI-generated material submitted to the courts, professional responsibility and supervision, and the use of AI by expert witnesses. Members also advise businesses and professional firms on liability arising from the use or non-use of AI, AI-assisted decision-making, confidentiality and legal professional privilege, and the contractual and regulatory issues arising from AI adoption.

Chambers’ strength in professional liability and regulation gives members particular expertise in questions arising from the increasing use of AI by lawyers, accountants and other professionals.

Our experience includes:

• R (Ayinde) v London Borough of Haringey – representing the barrister defendant in proceedings concerning suspected AI hallucinations, in which the High Court gave important guidance on the use of AI by lawyers;
• cross-examination of an expert witness concerning suspected use of AI to generate material submitted to the court;
• advising on disciplinary proceedings arising from suspected AI misuse;
• advising businesses and professional firms on the use and implementation of AI, including questions of liability, professional responsibility, supervision and contractual risk; and
• advising on liability and causation arising from AI-assisted professional decision-making.

AI regulation and legal developments

Members of 4 New Square are actively involved in the development of the law and regulation governing artificial intelligence.

Isabel Barter contributed to the UK Jurisdiction Taskforce’s Legal Statement on Liability for AI Harms, examining the application of the private law of England and Wales to AI related harms, including professional responsibility, causation, duties of care and AI assisted decision making.

Helen Evans KC is a Co Chair of COMBAR’s team responding to the review into the use of AI in court documents and has written and spoken extensively on AI, litigation, professional liability and regulation.
