Funding representative actions after Lloyd v Google
Lloyd v Google marks a seminal moment for representative actions. The ramifications…
Ben has a wide-ranging civil practice. Ranked as a Star Individual in Chambers & Partners, and nominated as the Legal 500’s Commercial Litigation Silk of the Year for 2023 and 2024, his reputation as an imaginative and creative problem-solver has seen him instructed in many prominent cases across multiple fields of law, not just in his bedrock areas of insurance and financial services litigation, but ranging from libel (recently acting for the successful appellant in Banks v Cadwalladr), to appeals on statutory interpretation (recently acting for the successful claimants in test cases on the effect of the Civil Liability Act 2018), to the most recent decision of the Supreme Court on pure economic loss in tort (acting for the successful appellant in Armstead v Royal and Sun Alliance).
Ben is also well known for his specialist practice in the law relating to solicitors, litigation funders, claims management companies and legal costs. He has acted in almost all of the main reported cases in this area in the last 20 years, most recently representing the successful solicitor in the Law Society Gazette’s so-called ‘costs case of the decade’ (Belsner v Cam Legal). Ben has also acted in almost all of the leading cases concerning credit hire companies, from Lagden v O’Connor onwards.
Ben is also frequently instructed in group litigation, both as lead counsel and as a specialist consultant on funding and procedural issues. He has acted in group cases as disparate as environment pollution claims, personal injury, data breach and financial mis-selling claims, and in follow-on claims in the CAT from Merricks v Mastercard through to Evans v Barclays Bank. He is presently instructed in the Diesel Emissions litigation against vehicle manufacturers, said to be the largest collection of group claims ever seen in the High Court.
Ben is also a member of the Bar of the British Virgin Islands and a Recorder of the Crown Court. He is an editor of Blackstone’s Civil Practice (OUP), and was previously an editor of both the White Book and Cordery on Legal Services.
