Supreme Court set for BI Test Case Appeal

The Supreme Court has granted permission for an expedited leapfrog appeal in the FCA test case to determine whether certain business interruption policies respond to losses arising out of COVID-19. The hearing has been listed for four days starting on 16 November 2020.

Five members of 4 New Square are acting for two of the insurers involved in the appeal: David Turner KC, Clare Dixon, Shail Patel and Anthony Jones are instructed by DWF for Royal & Sun Alliance Insurance Plc while Miles Harris is part of the counsel team instructed by Allen & Overy for Hiscox Insurance Company Limited.
