Scott Allen successfully defends valuer’s negligence claim:  Bratt v Jones

On Friday, 22nd March 2024, HHJ Cawson KC sitting as a Deputy Judge in the Chancery Division handed down judgment in Bratt v Jones, dismissing a multi-million pound valuer’s negligence claim.

4 New Square Chambers’ Scott Allen acted for the expert valuer in a successful defence against allegations of breach of contractual obligations and duties of care. The claimant sought damages of £4.9 million, including interest, alleging that the valuer had substantially undervalued the property in question, resulting in financial losses for the claimant.

The judgment examines in detail the correct way to assess liability in valuers’ negligence cases, reviewing and synthesising the existing, often conflicting, case law.
