4 New Square Chambers’ Diarmuid Laffan acted for the International Tennis Federation in its successful appeal against the decision of a first-instance tribunal exonerating Swedish top-100 tennis player Mikael Ymer of an anti-doping rule violation. Diarmuid was instructed by Chris Lavey of Bird & Bird LLP.
Mr Ymer committed three whereabouts failures (specifically, missed three out-of-competition drug tests) in the 12 months prior to 7 November 2021. Following a contested hearing on 25 April 2023 the CAS Panel concluded that, contrary to the first-instance decision, Mr Ymer had acted negligently in relation to the third whereabouts failure and the elements of the offence were accordingly made out. An 18-month suspension from competition was imposed.
