Al Jaber v Al Ibrahim: Shail Patel successfully defends international businessman in $30m Commercial Court claim

Following a ten-day trial in April 2023, judgment was handed down on 10th November 2023 in a $30m Commercial Court claim in which 4 New Square Chambers’ Shail Patel acted for the successful Second Defendant.

Mr Justice Henshaw rejected the Claimant’s claim that $30m paid in 2002 was a loan made to the Defendants, and accepted the Second Defendant’s case that it was fee for services he had provided in connection with property developments in Saudi Arabia. The decision also involves a detailed analysis of Sharia law principles relating to contractual formalities and the law of limitation.
