The Court of Appeal handed down judgment in Rollerteam v Riley [2016] EWCA Civ 1291 on Friday, 16 December 2016. The appeal concerned the interpretation of section 2 of the Law of Property (Miscellaneous Provisions) Act 1989. The Court of Appeal held that section 2 does not apply to contracts in which part of the consideration is the actual disposition of an interest in land; the formality requirements in that section apply only to contracts for the future disposition of such interests.
