Oliver has a particular focus on business protection disputes, regularly acting in matters involving urgent injunctive relief, restrictive covenants and the protection of confidential information and other business assets.
He acts for both businesses and individuals in disputes concerning the protection of commercial interests, including injunction applications arising from employee departures and alleged breaches of post-termination restrictions. He regularly appears as sole counsel in injunction hearings involving competition, solicitation of clients and staff, misuse of confidential information and the enforcement of contractual protections.
His practice extends to disputes between commercial entities concerning contractual provisions in restraint of trade. He advises on the full range of issues arising in business protection disputes, from the prospects of obtaining or resisting urgent injunctive relief to the wider commercial and strategic considerations.
Recent Experience:
Oliver has a broad commercial litigation practice, with experience across complex, high-value disputes involving commercial, contractual and fraud-related issues.
He is currently part of the counsel team acting for a number of Panamanian companies and foundations in Bourlakova v Bourlakov & ors, a high-value commercial dispute before the Chancery Division concerning assets valued in excess of US$1 billion. The litigation involves complex issues relating to asset ownership, jurisdiction and allegations of fraud, together with extensive interlocutory applications and case-management hearings. He is closely involved in the ongoing conduct of the proceedings.
He accepts instructions across all stages of commercial disputes, including advisory work, pleadings, applications and trials.
Oliver has experience across the full range of professional liability work, including professional negligence, professional discipline and regulatory proceedings.
He has a particular interest in professional discipline and regulatory matters, having been instructed by the Solicitors Regulation Authority in a number of disciplinary proceedings involving allegations capable of removing a professional from the register, including dishonesty, sexual misconduct and fraud. His experience extends across the life of a disciplinary matter, from advising on the merits and preparation of cases through to contested hearings before the Solicitors Disciplinary Tribunal, where he has appeared as sole counsel. His wider commercial and employment practice gives him particular insight into the interaction between a professional’s contractual obligations, regulatory duties and the consequences of disciplinary action.
His professional negligence practice includes claims arising from the provision of legal and other professional services. He has experience of substantial negligence claims against solicitors involving allegations of negligent advice and conduct in high-value litigation. His experience includes advising on complex issues of professional duty, causation and loss, as well as the assessment of claims arising from alleged professional failings.
He is currently instructed as sole counsel for the defendant commercial property agent in a substantial commercial dispute involving allegations of professional negligence and breaches of the RICS Rules of Conduct. The matter is listed for a five-day trial.
Drawing on his wider commercial and civil practice, Oliver is accustomed to dealing with complex factual disputes, expert evidence and allegations of dishonesty. He accepts instructions at all stages of proceedings, including advisory work, drafting, interlocutory applications, trials and disciplinary hearings.
