Nick’s commercial practice encompasses a wide variety of complex business and corporate disputes, including banking and financial litigation, insurance claims, professional liability claims, partnership disputes, claims against directors, cases arising from the provision of goods and services and claims involving breaches of trust and recovery of assets. He is often instructed by businesses, lenders, professionals and insurers in cases involving allegations of fraud.

He has acted in cases with such diverse subject matter as the interpretation and enforcement of commercial contracts (including insurance policies, share purchase agreements and financial instruments), the recovery of funds and assets (including misappropriated client and trust funds, debt claims and fee disputes), the provision of goods and services, the operation and administration of online accounts and market places, sports and esports disputes (including disputes about racehorses, football agents’ fees, transfers, funding and sponsorship) and claims involving luxury and classic cars (including claims arising from their international transportation, restoration and ownership).

CMC Spreadbet plc v Tchenguiz [2021] EWCA Civ. 849 – Nick was instructed to resist a lastminute application to adjourn a trial on grounds of ill health. The adjournment was refused at first instance ([2021] EWHC 1307 (Comm)) but was ultimately granted by the Court of Appeal.
Phoenix Interior Design Ltd v Henley Homes Plc [2021] EWHC 1573 (QB) – Nick acted (as sole counsel) for a property developer and hotelier in a dispute with an interior design company. The claim concerned the law of goods and services, the incorporation of contractual terms and the enforceability of exclusion clauses.
A claim between a funder and football agent arising from fees due following the successful transfer of a South American footballer to a club in the English Premier League.
Kuznetsov v Amazon Services Europe Sarl [2019] EWCA Civ. 964 – Nick successfully appeared (as sole counsel) for Amazon in the Court of Appeal. The appeal determined when a judge has the right to set aside an earlier judgment made in the absence of one of the parties under CPR r.27.11.
Abbey Forwarding Ltd (in liquidation) v Revenue and Customs Commissioners [2015] EWHC 225 (Ch); [2015] Bus L.R. 882 – acting for the successful liquidators of a company in a claim to enforce an undertaking against HMRC.

Nick has experience of complex professional liability claims and appeals at all levels, up to and including the Supreme Court. Defending a firm of solicitors in a multi-million-pound claim by an offshore company for the (alleged) lost opportunity to develop a commercial property in Wimbledon Village following unsuccessful litigation against its commercial tenants.
Manoj Saluja v Vyman Solicitors [2026] EWHC 229 (KB); [2026] P.N.L.R 15 – Nick acted (as sole counsel) for the successful solicitors in a trial of two claims arising from back-to-back commercial loans. The Court considered the guidance in Etridge, dismissing both claims in their entirety.
Joseph v McFaddens LLP [2025] EWHC 3596 (Ch) – Nick acted (as sole counsel) for the successful respondent in an appeal against an order declining jurisdiction over a claim in which the claimant failed to serve her Particulars of Claim in time.
Pontis Finance LLP v Karam, Missick & Traube LLP – Nick acted for a firm of solicitors in a claim by a lender arising from an alleged imposter fraud. The case has become well-known for the judgment of Deputy Master Henderson concerning the correct treatment of hourly rates when cost budgeting: [2025] EWHC 2298 (Ch).
Milford Investments Ltd v Lanyon Bowdler LLP [2024] EWHC 3227 (Comm) – Nick acted (as sole counsel) for a firm of solicitors in a claim by a developer arising from a failed joint venture. The case determined that, unlike limited companies, limited liability partnerships can be bound by the pre-incorporation agreements of its members.
Defending a firm of solicitors in a high-value claim arising from the claimant’s acquisition of an apartment. The claimant sought to recover losses arising from the conveyancing transaction as well as those arising from his unsuccessful litigation in the Lower Tribunal, Upper Tribunal and the Court of Appeal.
Defending a firm of solicitors in a substantial claim arising from the delayed disclosure of a medical clinic’s insurance position in the managed PIP litigation. The assignment of the claim gave rise to the privilege issues resolved by the Court of Appeal in Travelers Insurance Co Ltd v Armstrong [2021] Lloyd’s Rep I.R. 454.

Matthew v Sedman [2021] UKSC 19; [2022] A.C. 299; [2021] 2 W.L.R. 1232; [2021] 4 All ER 477 – Nick acted for the successful trustees in both the Court of Appeal and the Supreme Court. The case conclusively determined the important question of when time starts to run for limitation purposes in cases involving a “midnight deadline”.
Advising on the interpretation of the Institute of Chartered Accountants Minimum Approved Policy Wording for the purposes of arbitral proceedings against an accountant’s insurer.
Appearing at trial (as sole counsel) for a company in the successful defence of a claim by its auditors for fees over and above those contractually payable under the auditor’s retainer.
Advising liquidators in relation to claims against fund managers and auditors in the Caribbean following the loss of significant funds by investors in a high-profile Ponzi scheme.
Scriven v Scriven [2015] EWHC 1690 (Ch) – successfully defended a firm of accountants in a significant, long-running, trial arising from a family dispute over the ownership and management of London tourist attraction “The London Bridge Experience”.

Defending an insurer from an exaggerated claim supported by suspicious invoices made on an insurance policy following a fire at commercial premises in Luton.
Malhotra v Aviva Insurance [2025] EWHC 1090 (Comm) – Nick acted for insurers in a claim arising from an escape of water at a hotel. The claim concerned the cause of the flood and the interpretation of the fraud condition.
Defending a property management company from a high-value contribution claim by insurance brokers following a fire at commercial premises in Glasgow and litigation between the property owner, insurers and broker.
Represented insurers in an application to judicially review a decision of FOS on the basis that the Ombudsman had failed to consider written submissions from the insurer before making a final decision.
Spire Healthcare Ltd v Royal & Sun Alliance Plc [2020] EWHC 3299 (Comm); [2021] Lloyd’s Rep. I.R. 182 – a claim concerning the interpretation of an aggregation clause. The insurers’ interpretation of the relevant policy provisions was rejected at first instance but was ultimately accepted by the Court of Appeal: [2022] EWCA Civ. 17; [2022] Lloyd’s Rep I.R. 130.
An arbitration concerning an insurer’s obligation to indemnity its insured under a trade credit policy.
Hedges v International Insurance Company of Hannover SE & Anr (unreported) – Nick (as sole counsel) successfully defended the insurer of a gentleman’s club. The claim was dismissed at trial on the bases that the insured had made material misrepresentations prior to inception and had acted in breach of the policy.
Wheeldon Brothers Waste Ltd v Millenium Insurance Co Ltd [2018] EWCA Civ. 2403; [2019] 4 W.L.R 56; [2019] 1 All E.R. 297 – Coulson LJ gave guidance on the principles applicable to appealing findings of fact by specialist judges of the TCC.
Bluebon Ltd v Ageas (UK) Ltd [2017] EWHC 3301 (Comm); [2018] Lloyd’s Rep I.R. 503 – acted for the successful insurer in a trial concerning the interpretation and effect of a suspensive condition.
Bate v Aviva Insurance UK Ltd [2014] EWCA Civ. 334; [2014] Lloyd’s Rep I.R. 527 – A claim arising from a fire at a substantial private residence. Insurers successfully established that the claim was supported by forged documents and defended a claim for breach of ICOB rules. Nick acted for the insurer at first instance ([2013] EWHC 1687 (Comm)), in the Court of Appeal ([2014] EWCA Civ. 334) and in subsequent contempt proceedings ([2014] EWHC 4065 (QB)).

Manoj Saluja v Vyman Solicitors [2026] EWHC 229 (KB); [2026] P.N.L.R 15 – Nick (as sole counsel) successfully defended a firm of solicitors in two claims arising from back-to-back commercial loans. The Court considered the guidance in RBS v Etridge (no 2) about the independence of the solicitor instructed to advise the third-party surety.
Instructed by the successful lender in a claim against a company and personal guarantor, in which it was alleged that various documents were procured by fraud and/or were signed without authority. The claim also raised issues of equitable subrogation, the law of LPA receivers and allegations that a property had been sold at an undervalue.
Mortgage Express v Valerie May Vivian & Others (unreported) – Acted for the successful mortgagee at trial and in the subsequent applications for permission to appeal. The case concerned the mortgagee’s right to recover sums owed by a deceased mortgagor and gave rise to issues of adverse possession, limitation, family trusts, overriding interests, overreaching and equitable subrogation.
NRAM Ltd v Evans [2020] EWCA Civ. 1660 – Nick appeared on behalf of the successful lender in the Court of Appeal. The application concerned issues of limitation and a mortgagee’s rights under its legal charge.
Santander UK plc v Robert Garside (unreported) – Nick acted for the successful mortgagee at trial in a claim arising from an alleged fraud by a mortgage broker and purported breaches of the Financial Services and Markets Act 2000.
Landmark Mortgages Ltd v Bamrah [2017] EWHC 2014 (QB) – Nick acted for the successful mortgagee at trial and on appeal to the High Court. The claim concerned the mortgagee’s right to recover its mortgage debt from a deceased mortgagor’s estate, the priority of competing property rights and possession of land. The appeal concerned the level of debt recoverable by the mortgagee.
Dunfermline Building Society v CBRE Ltd [2017] EWHC 2745 (Ch); [2018] P.N.L.R. 13 – Nick acted for a building society in a claim against a valuer arising from the valuation of a development site for lending purposes.
Mortgage Express v Lambert [2016] EWCA Civ. 555; [2017] Ch. 93; [2016] 3 W.L.R. 1582; [2016] H.L.R. 34 – Nick acted for the successful lender at trial and in the Court of Appeal. The case involved issues of equitable subrogation, overriding interests and overreaching.
Isaaks v Charlton Triangle Homes Ltd [2015] EWHC 2611 (Ch) – Nick acted for the successful mortgagee (acting under its power of attorney) in a claim to rectify both a lease of a residential property and the Land Register.
Re North East Property Buyers Litigation [2014] UKSC 52; [2015] A.C. 385; [2014] 3 W.L.R. 1163; [2015] 1 All E.R. 277; [2014] H.L.R. 48; [2015] W.T.L.R 1067 – Nick acted for two of the successful mortgagees in the Supreme Court. The appeal concerned “sale-and-rent-back agreements” and addressed important issues of property law, overriding interests, land registration and equitable interests.
Pathania v Adedeji [2014] EWCA Civ. 681 – Nick appeared for a mortgagee in the Court of Appeal in an appeal concerning the effect of bankrupt’s failure to disclose his bankruptcy on a judgment obtained by him prior to the appointment of his trustee in bankruptcy.

Nick has considerable experience of private client disputes involving registered and unregistered land (including issues of ownership, rights over land and issues of land registration), property damage, private lending, the administration of trusts and estates (including claims for an account, breaches of duty and the recovery of trust and estate assets), proprietary estoppel and constructive trusts, and cases involving issues of fraud, unjust enrichment and restitution.

Defending a firm of solicitors in a claim for damages by a disappointed beneficiary and the estate following the settlement of a claim under the Inheritance (Provision for Family and Dependents) Act 1975.
Advising the professional executors of a significant estate in relation to a claim for an account by the charitable beneficiaries.

Advising an executor in relation to a claim by several charities arising from the alleged dissipation of the estate’s assets for the benefit of a co-executor.
Instructed to defend a former deputy and a firm of solicitors from a claim pursued in the Court of Protection arising from the dissipation of a protected party’s assets.
Acting in several claims by mortgagees against the estates of deceased mortgagors.

Nick has significant experience of advising property owners, leaseholders, banks and building societies, insurers and trustees (in the UK and offshore) on all aspects of English property law and in relation to claims involving registered and unregistered land. He has been instructed in cases involving:

issues of land registration (including overriding interests, the priority of competing interests and overreaching);
title rectification and rectification of the Land Register;
proprietary estoppel and constructive trusts;
co-ownership, trusts of land and applications under the Trusts of Land and Appointment of Trustees Act 1996;
fraud (including identity theft, imposter fraud and forgery) and equitable wrongs (including misrepresentation, undue influence, duress and unconscionable bargains);
landlord and tenant disputes (including cases involving forfeiture and possession of land);
easements, restrictive covenants and option agreements;
the construction of leases and leasehold covenants;
all aspects of the law of mortgages;
Law of Property Act receiverships.

Recent and Notable Cases

A claim by a private client for an interest in a field by way of a constructive trust, proprietary estoppel or the law of agency after the owner reneged on an arrangement to jointly acquire the land.
Instructed in separate cases to advise upon the existence, enforceability and priority of purchasers, and unpaid vendors, liens.
Advising on the position of long leaseholders under the Land Registration Act 2002 following the sale of their apartment block prior to the registration of their leases at HM Land Registry.
Several, unrelated, claims concerning the existence of rights of way following the historic division and transfer of land.
Sunman v Chellew & Others [2019] UKFTT 0592 (PC) – Nick acted for the successful freeholder in a case before the First-Tier Tribunal (Property Chamber) concerning the validity of a lease purportedly granted over unregistered land.
Mortgage Express v Lambert [2016] EWCA Civ. 555; [2017] Ch. 93; [2016] 3 W.L.R. 1582; [2016] H.L.R. 34 – Nick acted for the successful lender at trial and in the Court of Appeal. The case involved issues of equitable subrogation, overriding interests and overreaching.
Isaaks v Charlton Triangle Homes Ltd [2015] EWHC 2611 (Ch) – Nick acted for the successful mortgagee (acting under its power of attorney) in a claim to rectify both a lease of a residential property and the Land Register.
Re North East Property Buyers Litigation [2014] UKSC 52; [2015] A.C. 385; [2014] 3 W.L.R. 1163; [2015] 1 All E.R. 277; [2014] H.L.R. 48; [2015] W.T.L.R 1067 – acted for two of the successful mortgagees in the Supreme Court. The appeal concerned “sale-and-rent-back agreements” and addressed important issues of property law, overriding interests, land registration and equitable interests.

He contributed to The Law of Mortgages (4^th ed), and he has had articles published in the ICC FraudNet Global Annual Report, the Journal of Professional Negligence, the Journal of International Banking and Financial Law, the BILA Journal, the Property Law Journal, the Trusts and Estates Law & Tax Journal and the TecBar Review.

Before being called to the Bar, Nick read jurisprudence at Mansfield College, Oxford, where he was awarded an Exhibition, the Mansfield College Essay Prize, the Worsley Prize and a number of Collections Prizes. He studied for the BVC at BPP Law School and was graded Very Competent. Nick is a member of Lincoln’s Inn and has been awarded Hardwicke, Denning and Shelford Scholarships.
