Arvind Nayar is predominantly a commercial litigator from India, practicing in the Supreme Court as well as State High Courts and Tribunals across the country.
He comes with extensive experience in representing parties in dispute resolution matters in a cross section of courts as well as before arbitral tribunals. Arvind is frequently appointed as an arbitrator and mediator in ad-hoc and institutional arbitral tribunals constituted as per the LCIA, ICC and DIAC rules and is a known name in the international arbitration circuits across India, Singapore, Dubai and the United Kingdom.
Arvind has been a practicing advocate in India since 1997, and was designated as a Senior Advocate by the Delhi High Court in 2017. Arvind has also been a Solicitor of England and Wales, having cleared the Qualified Lawyers Transfer Test in London in 2001. In a career spanning over 20 years, Arvind has built a robust practice involving civil & commercial litigation, disputes involving banking & finance, intellectual property, energy & utility services, labour & employment and regulatory systems. Apart from representation in court, Arvind has a significant volume of advisory work and is often consulted for legal opinions on varied issues, by both domestic and international clients including advice on litigation strategy.
With an already formidable reputation as an advocate in Company Law disputes, within the short span since the Insolvency & Bankruptcy Code (2016) was introduced in India, Arvind has become the preferred senior counsel for banks, non-banking finance corporations, investment funds and other such companies, in the matters of insolvency and debt recovery. He is regularly engaged for interim relief, arguments at trial and appellate advocacy before various benches of the National Company Law Tribunal as well as the National Company Law Appellate Tribunal.
In arbitration disputes, Arvind has significant experience in India, as well as in the International arena. His area of expertise is particularly against government entities in India, representing private parties in disputes involving the awards of tenders, pharmaceutical distribution agreements, invocation of bank guarantees, construction and development agreements and mining contracts.
Whilst his focus is primarily on commercial litigation, Arvind has also often been engaged in criminal matters with favourable outcomes. In a landmark judgement of 2016, he represented victims of an infamous hit-and-run case and was able to procure trial of the accused as an adult, the first such prosecution since the law was amended in 2013. Recently, in 2020, as part of his Pro-Bono appearances, he acted as counsel in a public interest litigation and successfully procured rights for prison inmates of secure access to their lawyers via video conferencing during the Coronavirus pandemic.
Arvind has immense experience representing and advising clients in matters ranging from joint venture & shareholder disputes, civil fraud, construction claims and insurance disputes. He appears regularly for parties in consumer protection disputes as well as being appointed frequently to argue civil and criminal writ petitions.
Along with managing his thriving legal practice, Arvind is a known name as a panellist and speaker in conferences and, more recently, webinars within India and abroad. He has been invited to speak on a range of subjects from ‘Choosing the seat in International Arbitration; an overview of the leading European and Indian arbitral centres’ at the LCIA European Users’ Council Symposium (Madrid, 2009) to discussing the ‘Dispute resolution process in India’ at the InformaConnect Law Conference (London, 2019). As part of his initiative to give back to the profession, Arvind is an Honorary Adjunct Professor of Law & Distinguished Professor of Legal Practice at the Jindal Global Law School of O.P Jindal Global University, India and is an acknowledged mentor to his junior staff and interns.
Before commencing his independent practice in 2001, Arvind was part of a few leading Indian law firms and trained under some of the country’s most eminent commercial litigators.
On the personal front, Arvind has authored a book, Operation Karakoram, an espionage thriller, published in 2005. He rates London amongst his favourite cities in the world.
Arvind is regulated by the Bar Council of Delhi.
