PM Law Ltd v Motorplus Ltd EWCA Civ 1730: Court of Appeal decision on referral relationship between solicitors and legal expenses insurance agency
Jonathan Hough QC successfully resisted the appeal of the claimant firm of solicitors concerning the interpretation and effect of a referral agreement between it and a major legal expenses insurance underwriter. The Court of Appeal rejected the claimant’s argument that the agreement had obliged the defendant to refer any minimum number of cases. In doing so, it upheld a decision of Sir Richard Field dismissing claims pleaded at about £5 million. Jonathan had previously appeared for the defendant in striking out other claims in the action pleaded at over £3 million: see EWHC 193 (QB).
