Nicholas Bacon KC represents the successful appellants in a significant appeal court ruling on the recovery of costs by Private Prosecutors pursuant to the Prosecution of Offences Act 1985, s.17. The Lord Chancellor sought to uphold the finding of the lower court. However, the appeal court agreed with the Appellants and held that the Costs Judge had been wrong to disallow all of the pre-commencement/pre issue costs. The case provides much welcomed clarity for private prosecutors looking to recover their costs of bringing proceedings under the POA 1985.
