4 New Square Chambers’ Justin Fenwick KC acted for the successful respondent in today’s Supreme Court decision in Kireeva v Bedzhamov.
The panel of five justices upheld the “immovables rule,” confirming that foreign courts cannot enforce orders on English land. Bedzhamov had been declared bankrupt in Russia following the collapse of Vneshprombank, but the Supreme Court reaffirmed that English property law takes precedence over foreign bankruptcy proceedings at common law.
