Intra-EU BIT Arbitrations declared incompatible with EU Law: Judgment rendered in C-284/16 – Slowakische Republik v Achmea BV

Today, the Court of Justice of the European Union (“CJEU”) delivered its much-anticipated Judgment in Case C-284/16 – Slowakische Republik v Achmea BV. It decided not to follow the Advocate General’s Opinion and has declared that intra-EU BIT arbitrations are incompatible with EU law. The consequences of this Judgment may be far-reaching.
