Graham Chapman KC and Scott Allen successful in significant appeal before the Judicial Committee of the Privy Council in London

Graham Chapman KC and Scott Allen of 4 New Square Chambers, instructed by Conal Keane of Dillon Eustace LLP, successfully represented IGCF SPV 21 in a significant appeal before the Judicial Committee of the Privy Council in London.

The case concerned an anti-suit injunction obtained by IGCF SPV 21 Limited – a special purpose vehicle holding a substantial stake in K-Electric, Pakistan’s largest energy company – in respect of an injunction obtained by other shareholders in Pakistan. The case determined the question of what the law of the Cayman Islands is in respect of submission to a foreign jurisdiction, with the Privy Council in an important judgment clarifying that the test for submission is the same in the Cayman Islands for anti-suit injunctions and enforcement of foreign judgments, and is in line with the modern English authorities.
