George McDonald secures another major PFI victory

George McDonald of 4 New Square secures another major PFI victory, obtaining summary judgment for £60 million.  Following a successful appeal to the Court of Appeal in February 2018, George (being led by Anneliese Day QC of Fountain Court) acted for Birmingham City Council in its ongoing commercial dispute with its partnering contractor in relation to a £2 billion PFI contract. After a hard-fought hearing on 4 October 2018,  Mr Justice Stuart-Smith granted all the relief sought by the local authority, including important declarations and repayment of £55 million found to be wrongly paid to the contractor plus interest of £5 million.
