Mediation
Mediation is a voluntary form of alternative dispute resolution (ADR) in which an independent third party mediator assists the parties to reach a mutually acceptable settlement. Mediation is speedy, cost-effective, flexible and confidential, with significant advantages to the parties over a court hearing. Mediation can take place at an early stage, before the parties become locked in to litigation, or at any time thereafter. Unlike litigation or arbitration, in a mediation the parties are in control of the outcome.
Mediators do not take sides or make decisions, nor do they offer advice to the parties; they remain neutral at all times, and are able to facilitate resolutions to disputes which had hitherto seemed intractable. Since mediation is a confidential and without prejudice process, nothing said or done during the mediation day is disclosed to any third parties outside the mediation, and in the event of the parties being unable to reach agreement, details of what happened at the Mediation cannot be disclosed in any later or continuing litigation or arbitration.
4 New Square’s Mediators are trained or accredited by the leading institutions in the field in the world, and act impartially and independently of the parties to facilitate the resolution and settlement of disputes in a wide range of areas: for example, but not limited to, commercial, construction and engineering, sports, entertainment, technology, international, insurance and reinsurance and professional liability and indemnity disputes.
Our Mediators are on a number of mediation lists, including the Centre for Effective Dispute Resolution, American Arbitration Association, ADR Chambers, Court of Arbitration for Sport. Our Mediators are skilled at resolving cross-cultural or cross-border disputes, particularly in Europe, North America, and Asia. Our Mediators are also skilled at the uses of mediation in International Commercial Arbitration, and we have a particular, and leading, expertise in mediating sports cases.
Our Mediators are able to adapt a variety of different mediation styles with the parties depending on preferences or the nature of the dispute, from evaluative to facilitative. Not only are our Mediators accomplished neutrals, but they also teach mediation regularly and are called upon to present on mediation topics around the world.
Convening a mediation with 4 New Square
Mediations can be held at our premises at 4 New Square, where we have a fully serviced mediation suite, with conference rooms, breakout rooms and relevant technology. Alternatively, mediation can take place at a venue agreed by the parties.
Our Mediators can be engaged for a fixed fee plus any travelling expenses, usually shared equally between the parties, which includes all preparation for and attendance at a mediation session, typically 10 am to 6.30 pm, or whenever the parties prefer, each day of the mediation. Sometimes in more complex cases a multi-day or extended day mediation will be necessary; equally, it may be possible to resolve matters in a half-day mediation.
