21 May 2021

Clare Dixon KC and Nicholas Broomfield of 4 New Square Chambers (instructed by Mills & Reeve LLP) represented the successful respondents in a ruling on how the limitation period should be calculated when the cause of action accrues at the stroke of midnight. The Supreme Court found that the whole of the day after midnight falls to be included in the computation of time and as a consequence part of the claim was statute barred.

The decision of the Supreme Court is considered here.
