Cayman Grand Court grants anti-suit order

News & Judgments
2 March 2018

In a judgment issued on 13 February 2018 the Grand Court of the Cayman Islands granted an anti-suit order restraining proceedings that had been commenced in New York in breach of Cayman governing law and jurisdiction and arbitration agreements. The Court also enforced “sole recourse” provisions in the relevant contracts. The injunction extended to restrain the New York proceedings against both the contracting counter-party and three related parties against whom proceedings had been brought.

The successful applicant was represented by Graham Chapman QC. For further analysis of the decision in an article prepared by Campbells, who instructed Graham, please see click here.
