Success for 4 New Square Chambers teams in c.£68m negligence claim arising from unit sales in failed property developments: Afan Valley Limited & Ors v Lupton Fawcett and Metis

Mr Justice Sheldon has recently handed down judgment in Afan Valley Limited & Ors v Lupton Fawcett and Metis in relation to two applications.

He struck out the claims against the Lupton Fawcett Defendants (represented by Daniel Saoul KC and Pippa Manby with assistance from Seohyung Kim) on the basis that the Claimants had not shown that any breach by the Lupton Fawcett Defendants had caused them to suffer any loss.

At the same time, Mr Justice Sheldon dismissed the Claimants’ application for permission to bring breach of trust claims totalling c. £56 million against the Metis Defendants, who were represented by Ben Hubble KC and Michael Bowmer, as well as refusing various other amendments.
