Conspiracy and inducing breach of contract as a weapon in the armoury of property litigators

In Thames Valley Housing Association v. Elegant Homes [2011] NPC 54, Lewison J held that the man behind an off-shore company was liable for conspiracy and for inducing breach of contract, the relevant contracts being the company’s contract to sell its land free from encumbrances and its contract to use the proceeds of sale in discharge of the mortgage over the property. Where the other party to a transaction is insolvent, this is an important means of recovery against third parties.
