Chambers has significant experience and strength in depth in the field of Insurance and Reinsurance. Several members of Chambers have practices which predominantly deal with insurance and re-insurance issues, ranging from general points of construction and scope of indemnity to non-disclosure and misrepresentation of material facts, breach of warranty/conditions, construction of terms, conditions and exclusions, fraud and related indemnity issues and aggregation. The claims cover a very wide range of value, from those of substantial value arising out of significant underlying losses to others of relatively small value but involving important points of principle. Members of Chambers write specialist books or chapters on the field, and regularly contribute articles to specialist publications such as Insurance Law Monthly.
Recent cases in which Members of Chambers have been instructed include the Employers’ Liability Policy Trigger litigation, the Kidsons professional indemnity coverage litigation and reinsurance issues relating to D&O claims arising from the discovery of fraudulent accounting to the tune of at least US$1Bn at a major Asian IT company. A team from Chambers is presently representing Indian insurers in an Arbitration where claims exceeding US$650M have been made in relation to cyclone damage to an oil refinery.
