Lessons in Wilful Default after Weavering

Earlier this year the Court of Appeal of the Cayman Islands handed down judgment in Weavering Macro Fixed Income Fund v Peterson, concerning the collapse of the fraudulent Weavering Fund and the use of exculpatory provisions and wilful default carve-outs. In a recent article for the Turkish Commercial Law Review, Justin Fenwick QC, Graham Chapman QC and Michael Ryan discuss the implications of this decision, which is of importance to commercial fraud litigation both domestic and international.
