Shawton Engineering Ltd v. DGP International Ltd (t/a Design Group Partners)

Reference: [2005] EWCA Civ 1359; LTL 18/11/2005

Court: Court of Appeal

Where a subcontract that required works to be completed by fixed dates had been varied, the work had to be completed within a reasonable time.  The contractor had failed to establish what was a reasonable time for completion of the works.  Therefore the subcontractor was not in breach of contract by reason of delay and a letter from the contractor could not have made time of the essence.
