Comment:
Where a subcontract that required works to be completed by fixed dates had been varied, the work had to be completed within a reasonable time. The contractor had failed to establish what was a reasonable time for completion of the works. Therefore the subcontractor was not in breach of contract by reason of delay and a letter from the contractor could not have made time of the essence.
