Undertakes a wide range of commercial work, including general commercial litigation, consumer credit, sale of goods, product liability, partnership disputes, personal and corporate insolvency and commercial contractual claims. Has regularly appeared in arbitrations concerning insurance and reinsurance, construction, engineering and environmental law and commercial litigation.
Recent and current cases include: • A contractual dispute as to whether computer goods supplied complied with terms as to fitness for purpose. • Arbitration concerning insurance cover following criminal allegations against Insured. • Arbitration under the National House Building Council 'Buildmark' scheme. • Mediation in numerous professional negligence claims. • Adjudication under HGCRA 1996. • Acting in an arbitration as to the enforceability of insurance cover in relation to product liability. • Advising and acting in numerous arbitrations invloving both domestic and commercial construction disputes. • Acting on behalf of french telecommunications company in respect of ICC arbitration.
Product Liability
Undertakes work in both personal injury and commercial context.
Recent cases include: • Claim for damage to commercial business following supply of allegedly defective vehicles. • Disputes as to quality of electrical products supplied to supermarket chain. • Representing the Department of Health in the Aspirin and Reyes Syndrome litigation, the CJD growth hormone litigation and the BSE/variant CJD litigation: (Human Growth Hormone/CJD Litigation 41 BMLR 157 and Amanda Smith v. Secretary of State for Health [2002] 67 BMLR 34).
