Comment

The primary issue in the case was whether or not work done by a solicitor in connection with the expert valuation of a share undertaken in the course of unfair prejudice proceedings was contentious business as defined by Solicitors Act 1974. The judges held unanimously that the business was contentious. This was the first time that the Court of Appeal has considered the definition of contentious business and hence the case is of general importance as it potentially alters the way in which solicitors can charge for work done. The case also provides valuable guidance on the occasions a court will allow a solicitor to amend a bill that has been sent to a client.
